Brea Building Division Adopts New California Code Regulations
The 2016 Triennial Code Adoption Cycle is complete and the resulting 2016 California Building Standards Code (Title 24, California Code of Regulations) is published and becomes effective statewide on January 1, 2017.  Online access to the 2016 California Codes is now available at the California Building Standards Commission website (www.bsc.ca.gov)

The City of Brea, CA Building & Safety Division provides plan review and field inspections of buildings to ensure a safe, accessible and energy efficient environment throughout our community. The Division regulates local and state laws related to building construction, maintenance, use, repair, and rehabilitation.

The Division also manages the city's permit system which coordinates and streamlines the construction permit process.

Applications for construction projects are submitted to the Building Division where the review process is coordinated among several departments.  This provides the customer with a comprehensive single point of contact throughout the entire review and permit process.

Permit Applications

Alarm Permit Application An alarm permit is required for all residential and commercial alarm users in the City of Brea (City Ordinance Chapter 8.38).
Building Permit Application Required for any building or construction taking place in Brea
Business License Application         
A business license is required of all businesses operating within the city limits, including temporary activities. An Out of City Contractor's Business License is required for those who do not reside in the city, but do work within the city.

Committee Application

Film Permit
Live performances need to be presented in an appropriate venue with the required permit. Film crews are required to have a permit before filming anywhere in the City of Brea.
Fire Permit Application           Fire Permit Applications must be submitted in person with 3 hard copies of plans and 1 electronic copy. The electronic copy must be in PDF Format. We accept check or credit card (Visa or Mastercard). Each permit paid by check needs to have separate checks. (Example: 3 permits is 3 separate checks)

The City of Brea General Plan was adopted on Aug. 19, 2003.

Updated for 2008 - 2014; this is the new replacement section for the 2003 General Plan.
Hillside Zoning Ordinance The City of Brea Hillside Zoning Ordinance was adopted on Oct. 19, 2004.
Request for Incident Report Form           This form is for requesting an incident report with the Brea Fire Department. It can be submitted via mail. fax, or dropped of at the Civic Center on the 2nd floor. 
Information Request Form          

The information request form is to request to view Fire Department records for buildings in the city. This form can be faxed, mailed, emailed, or dropped in person.

Non-Injury Traffic Collision Report Form          Use this form if you have been involved in a non-injury traffic collision on private property. Directions on how to complete this form are included.
Overnight Parking Permit     
Annual parking permits are intended to relieve parking situations. A permit may be obtained for any operable vehicle that needs to be parked overnight on the street in front of the residence.    
Notice Inviting Qualified Bidders        
The Public Works Department invites interested contractors to be placed on the City of Brea Qualified Contractor list, designed so contractors can receive "Notice Inviting Bids" for informal projects under $175,000 in their work category, per California Public Contract Code Section 22034. Only qualified contractors will be notified. Contractors must first complete and submit the following documents: a Pre-qualification Applicationand a Responsible Bidder Supplemental Questionnaire.
Possible Court Order Violation         
The purpose of this form is to document possible court order violations, such as child custody and possible restraining order violations.
Records Request Form       
The City of Brea provides accessibility to all public records unless expressed confidential or privileged under the law. By contacting the City Clerk's Office using this form, the documents can be made available to you.  
Report Release Form     
Use this form and directions sheet to obtain a police report. Fax, mail, or drop off your form at the Brea Police Department. Copies of arrest reports must be obtained via the North Justice Center District Attorney's Office.
Restraining Order Information        This contains general information about restraining orders with where-to-file information, including the three different types of restraining orders. 
Ride-Along Application      
To ride along with a police officer during his/her shift to see what's it's like, complete and submit this application.

Temporary Sign Permit Businesses wishing to display a temporary sign, such as a banner or streamers, must apply for a Temporary Sign Permit.
Temporary Use Permit     To be used for special events like sidewalk sales, jog-a-thons, or grand openings. This also includes Christmas tree lots and pumpkin patch sales.
Transient Occupancy Tax Report This is required for hotel, motel, or suite operations.
Uniform Project Application Universal application for the city's Planning Division
Vacation House Check Use this form when you are planning a vacation and would like the police to check your home while you're away. A one-week notice is appreciated.

Business License Requirements

A business license is required of all businesses operating within the city limits, including temporary activities and contractors with offices outside the city. Rates vary according to the type of business.

Applications
For your convenience, the following forms that can be filled out by either inputting the information on your computer, or by printing it out and filling it out by hand. Once you have completed the form, please follow the instructions at the top of the form. Any additional information regarding the business license can be obtained by calling the Administrative Services Department at 714-990-7686 or sending an email.


Unless your business is home-based, an application for a certificate of occupancy is also required in order to obtain a business license.

Payment of this tax does not constitute zoning, building, or fire code approval. Check with the Community Development Department in order to determine if your business can be legally established at your location.

Restaurant Requirements
New restaurants need to submit a fats, oils, and greases (FOG) application, in addition to applying to the City of Brea for a business license and certificate of occupancy. As part of the National Pollution Discharge Elimination System (NPDES) local municipalities are responsible to conduct inspections for correct handling of fats, oils, and greases.

Certificate of Occupancies

The City of Brea has a somewhat unique way of handling the Certificate of Occupancy (C of O). No building in the city is issued a C of O that gives a blanket approval to a whole host of businesses within a building code occupancy classification to move in. Instead, each business needs to obtain a separate C of O to occupy a portion of a building.

Individually owned dwellings are exempt from the C of O requirement. The C of O for an apartment is issued to the landlord and the C of O for a hotel is issued to the hotel operator. C of Os for commercial buildings are issued to each individual tenant.

An initial C of O shall be obtained by each business as a prerequisite for business license application. It needs to be renewed or revised when any of the following occurs:

  • Alteration to the building
  • Change of occupancy classification to the business operation
  • Change of the business tenant
  • Change of business ownership
  • Change of building ownership

C of O applications should be submitted to the Building and Safety Division, along with supplemental questionnaires. Building and Safety will complete the C of O process, which leads to the issuance of a C of O by the building official. The C of O must be posted in a conspicuous place on the premises at all times.  To check the status of a C of O application, search by address number and street name only (ex. 235 Berry).
